Please read the following terms and conditions carefully before booking a headshot photography session. By engaging these services, you agree to be bound by these terms and conditions:

Booking and Payment:
a. A non-refundable deposit is required to secure your booking. The remaining balance is due on or before the day of the scheduled session.
b. Payment can be made via cash, check, or any major credit card.
c. In the event you need to cancel your appointment within 24 hours of the session, the deposit may not be refunded.

Rescheduling:
a. Requests for rescheduling must be made at least 48 hours before the scheduled session. We will make reasonable efforts to accommodate the new date and time.
b. If the you fail to provide sufficient notice for rescheduling, the deposit may be forfeited.

Image Delivery and Copyright:
a. The final edited images will be delivered to you in a digital format within the agreed-upon timeframe.
b. You will receive a license for personal or business use of the images. However, the copyright of the images remains with the us, Kim Ayars Photography, LLC.
c. You may not sell or license the images to any third party without prior written consent from the us.

Usage and Release:
a. We may use the images for promotional purposes, including but not limited to the our website, social media, and marketing materials.
b. You grant us permission to use your likeness in this regard, without further compensation.
c. If you would prefer not to have your images used for promotional purposes, let us know before or during the session.

Image Selection and Editing:
a. You will select images from the session for editing and final delivery. You do not have the right to access or request unedited or raw files.
b. We will perform retouching and editing on the selected images to enhance quality and remove minor imperfections.

Client Cooperation:
a. You agree to arrive on time for the scheduled session and to cooperate during the shoot, following our instructions for posing and expressions.
b. We are not responsible for suboptimal results if the you fail to cooperate or follow instructions.

Liability:
a. We will take reasonable care to ensure the safety of you and your belongings during the session. However, we cannot be held responsible for any loss, damage, or injury incurred.
b. You release us from any liability associated with the use, display, or distribution of the images.

Privacy:
a. We respect your privacy and will not share personal information.

Force Majeure:
a. We will not be held liable for any failure or delay in performance due to circumstances beyond our control, including but not limited to acts of nature, accidents, or equipment failure.

Governing Law and Jurisdiction:
a. These terms and conditions shall be governed by and interpreted in accordance with the laws of Kane County, Illinois. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in Kane County, Illinois.

By booking a headshot photography session with the us, you acknowledge that you have read, understood, and agreed to the above terms and conditions.
